Decision made in the EIA report case of Sinpas Kızılbük Thermal Wellness Resort Project

The annulment lawsuit filed against the positive EIA decision for the Sinpas Kızılbük Thermal Wellness Resort Project was concluded.

Muğla 3rd Administrative Court decided to reject the annulment case.

The statement made by the company to PDP on the subject is as follows;

“In our Material Event Disclosure made through the Public Disclosure Platform (KAP) on 10.03.2023: “Environmental Impact Assessment Positive” decision was given for our EIA application submitted to the Ministry of Environment, Urbanization and Climate Change regarding our Sinpaş Kızılbük Thermal Wellness Resort project in Muğla province, Marmaris District, Kızılkum Mevkii, parcels 1598 and 2518.

On 30.05.2023, in the announcement we made through the Public Disclosure Platform (KAP) dated 30.05.2023, regarding our Sinpaş Kızılbük Thermal Wellness Resort project in Muğla province, Marmaris District, Kızılkum Mevkii, parcels 1598 and 2518, the Muğla Metropolitan Municipality has decided that the Muğla 3rd Administrative Court with the file numbered 2023/643, we had announced to the public that a lawsuit was filed for the cancellation of the EIA positive decision regarding our project, and that our comprehensive objection petition was submitted to the Court on 29.05.2023 based on the decision regarding the acceptance of our Company’s intervention.

The lawsuit filed by Muğla Metropolitan Municipality for the annulment of the EIA positive decision regarding our project with the file numbered 2023/643 Esas of Muğla 3rd Administrative Court, was decided by Muğla 3rd Administrative Court.
Administrative Court; Based on the expert report prepared within the scope of the information and documents within the scope of the file, the EIA report examines the possible impacts of the planned project on the environment and there is no deficiency according to the legislation in force, the EIA report is sufficient and appropriate, the examinations, calculations and evaluations made are based on sufficient data, information and documents,The cumulative effects of the project on the environment if it is active together with other projects to be carried out in the area have been examined comprehensively and it has been concluded that there is no violation of the law in the action subject to the lawsuit due to the fact that it is seen that the necessary measures to minimize the negative effects on the environment are included in the report.”
